  1. Using the Site website

    Reference to 'you', 'your' and 'yours' are references to the persons accessing the Site. References to 'we', 'us' and 'our' are references to NOCN Ltd.

    www.skillsfile.org (hereinafter referred to as 'the Site') is maintained for your personal use and viewing. Your access and use of this Site constitutes your acceptance of these Terms and Conditions which takes effect from the date on which you use this Site.

    We may at any time revise these Terms and Conditions without notice. Please check these each time you use the Site. You agree to review the Terms and Conditions regularly and your continued use of this Site will mean that you agree to any changes.

    These Terms and Conditions are to be read by you together with any terms, conditions and disclaimers provided in the pages of the Site. In the event of any conflict, the terms and conditions and disclaimers provided in the pages of the Site shall prevail over these Terms and Conditions.

    You are not entitled (nor will you assist others) to set up links from your own websites to the Site (whether by hypertext linking, deep linking, framing, tagging or otherwise) without the prior written consent of NOCN, which we may at our absolute discretion, and without providing a reason, grant or withhold.

  2. Intellectual property

    The contents of the Site and any other text, graphic, audio, video or images, contents, software, data and information are protected by copyright, trademark rights, database rights, patent rights, design rights. You may imprint, copy, down load or temporarily save extracts from the Site only for your own personal information.

    We allow you onto this Site in return for you agreeing not to adapt, alter or create any derivative work from any of the material contained in this Site.

    The names, images and logos identifying Cskills Awards, NOCN and Skillsfile are NOCN trademarks. The copying and use, in any manner, of the Cskills Awards logo, NOCN logo or Skillsfile logo, name or images is not permitted without prior written consent of NOCN. You can request permission to use either the NOCN or Skillsfile logo by directing enquiries to: Cskills Awards, NOCN, Bircham Newton, King's Lynn, Norfolk PE31 6RH

    All other trade marks, brand names, product names and titles and copyright used on this Site are used under license granted by their respective holders. No permission is given by NOCN in respect of the use of any of them and such use may constitute an infringement of the holder's rights.

    We are concerned about the safety and privacy of our users, particularly children. Parents/guardians who wish to allow their children access to and use the Site should supervise such access and use. By allowing your child access to the Site you are allowing your child access to all services including email, forums and/or other message or communication facilities. It is therefore your responsibility to determine which services are appropriate for your child.

  3. Your use of the Site

    Use of the Site is at your sole risk. NOCN’ liability for any loss or damage whatsoever and howsoever arising as a result of your use of or reliance on the information contained on the Site shall be excluded to the maximum extent permitted by law.

    Further, NOCN will not be liable for:

    • The accuracy or reliability of the information or content of the Site;
    • Problems including compatibility and damage or corruption of your Hardware, software or installation;
    • The security of the Site
    • Interruption in availability or errors of the Site;
    • The Site content failing to meet your requirements; or,
    • The accuracy, functionality or performance of any third party data, documents, material, information or software that may be contained on or used in connection with the Site

    The Site is intended for those who access it within the United Kingdom. We cannot therefore guarantee that the Site and its content is suitable for use in other places.

    Messages sent over the Internet cannot be guaranteed to be completely secure as they are subject to possible interception, loss or alteration. We are not responsible for them and will not be liable to you or anyone else for any damages or otherwise in connection with any message sent by you to us or any message sent by us to you over the internet.

    In accessing any part of this website, you agree:

    • Not to use this website in such a way that disrupts, interferes with or restricts the use of this website by other users;
    • Not to upload, display or transmit any materials through this website which are false, offensive, defamatory, threatening, obscene, unlawful or which infringe the rights of any other person anywhere in the world;

    • Not to interfere with or misuse data contained on this website and entered by or relating to any third party user of this website

    Material contained in this Site may be downloaded, viewed and printed for personal use or internal circulation within the user's organisation provided that no trade mark, copyright or other proprietary notices contained in or appearing on such material are removed in whole or in part. Material contained in this Site may not otherwise be copied, reproduced or redistributed in whole or in part without the prior written consent of NOCN. In particular it must not be reproduced or exploited for commercial gain. All other rights are reserved and users must ask permission from NOCN before making any other use of material contained in this Site. This permission to reproduce material does not extend to material identified as belonging to third parties, where users must obtain the permission of the relevant owners before reproducing such material.

  4. Viruses

    Whilst NOCN makes all reasonable attempts to exclude viruses from the Site, it cannot ensure such exclusion and no liability is accepted for any loss, disruption or damage to our data or your computer system which may occur whilst using material off the Site.

    You have sole responsibility for adequate protection and back up of data and/or equipment and for undertaking reasonable and appropriate precautions to scan for computer viruses or destructive properties. Thus, you are recommended to take all appropriate safeguards before downloading information from the Site.

  5. Third Party Websites

    The Site may provide links to other websites or services provided by third party organisations for information purposes only. If you access these websites via the links you are leaving the Site and NOCN shall not be responsible or liable for the content or dealings you may have with these third parties.

    No endorsement or approval of any third parties or their advice, opinions, information, products or services is expressed or implied by any information on our Site.

  6. Data Protection

    Please see our Privacy Statement. NOCN Privacy Statement forms part of these Terms and Conditions.

  7. Data Retention

    The system is provided for the sole purpose of assembling and demonstrating a portfolio of evidence for a vocational qualification. Any portfolios that were completed 3 years ago or more will be deleted in line with Ofqual's retention policy. If you would like to retain any evidence for any candidates who completed their qualification over 3 years ago, we advise that you download the evidence and store it outside of Skillsfile. We will also delete any portfolios that have been dormant for 3 years or more, again if you wish to retain information from dormant portfolios you can download and store the evidence for these as well. NOCN will undertake regular data cleansing to ensure that information isn't retained on the system past Ofqual’s stipulated timescales.

  8. Governing Law and Jurisdiction

    These Terms and Conditions are governed by and interpreted in accordance with the laws of England and Wales and the English Courts will have exclusive jurisdiction in respect of any dispute which may arise.
